2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
3. It is a case of dowry death.
4. Petitioner is brother-in-law (Bhaisur) of the deceased.
5. Learned counsel appearing for the petitioner submits that thrust of accusation is against husband of the deceased who is already in custody. Allegation against the petitioner is general and omnibus. Petitioner is separate in mess and property and is not concerned with family affairs of the deceased.

6. Learned counsel for the informant vehemently opposes the bail application and submits that petitioner is named in the F.I.R. This petitioner along with other accused persons caused death of daughter of the informant and this petitioner played an active role in commission of the offence and has got one criminal antecedent.

Considering the fact that thrust of accusation is against husband of the deceased who is already in custody, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-XXXVI, Patna in connection with Sessions Trial No. 465 of 2023 arising out of Digha P. S. Case No. 708 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
