This is and application for grant of anticipatory bail for offences punishable under Sections 47(a) Bihar Excise (Amendment) Act 2016.

Allegation is of recovery of 88 litres of foreign liquor. It has been submitted on behalf of the petitioners that petitioner has been falsely implicated in the present case and his name has come in this case only on the basis of suspicion. However, the other co-accused persons, having similar allegation have been granted the privilege of bail by this Court vide order, dated 25.11,.2016, passed in Criminal Miscellaneous No. 50799 of 2016 and order, dated 08.09.2016, passed in Criminal

Having heard both sides and in view of the fact that other co-accused persons, having similar allegations have been granted the privilege of bail, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Pradeep Kumar Chodhary, learned Judicial Magistrate -1st Class, Udakishunganj (Madhepura), in connection with Bihariganj P.S. Case No. 91 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
