The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

Thirty litres of country made liquor is recovered from the alleged hut of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The alleged hut from where recovery has been made does not belong to the

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge(Excise), Patna in connection with Maner P.S. Case No. 160 of 2021, Special Case No. 2476 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
