The present application has been filed for directing the Principal Judge, Family Court, Ara, Bhojpur, to transfer the Matrimonial Case No. 104 of 2017 to the Principal Judge, Family Court, Gaya.
Notices were issued to the opposite party who has appeared and has filed a counter affidavit. In the said counter affidavit, the opposite party has apprehended danger to his life but he has also given statement that he is willing to compromise the matter and live a harmonious matrimonial life with the petitioner. Be that as it may, this issue cannot be settled in the present transfer application. However, in the interest of justice and taking into consideration, the convenience of the petitioner which is of paramount importance, let the Matrimonial Case No. 104 of
Patna High Court MJC No.1858 of 2017 (6) dt.28-03-2018 2/2 2017 pending in the Court of Principal Judge, Family Court, Ara, Bhojpur, be transferred to the Court of Principal Judge, Family Court, Gaya.
The parties are directed to appear no sooner the records received in the concerned Court.
The application stands allowed.
