1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The learned counsel for the petitioners, after arguing vehemently for some times, seeks permission to withdraw the present quashing application with a liberty to the petitioners to raise all the issues at the time of framing of charge, if the charges, till date, have not been framed.

3. Permission is accorded.

4. Accordingly, instant petition is dismissed as

Patna High Court CR. MISC. No.56086 of 2023(2) dt.04-09-2023 2/2 withdrawn with the liberty aforesaid.

5. However, the Court expects that in the event, if discharge application is filed on behalf of the petitioners, the learned trial Court shall apply its independent judicial mind without being prejudiced by the fact that petitioners withdrew the quashing application before this Court.
