This is a petition for grant of anticipatory bail for offence under Sections 409, 420 and 188 of the Indian Penal Code. The petitioner is a Government servant and was working as Panchayat Secretary. Allegation is that he did not supply the dossier of the teachers appointed on contract to the authorities in spite of repeated reminders.
Submission of the petitioner is that no criminal offence is made out. Even if it is assumed that the petitioner disobeyed the directions of the superiors, it was a matter of disciplinary proceeding.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Gaunaha P.S. Case No. 50 of 2016 to the satisfaction of the Chief Judicial Magistrate West Champaran at Bettiah, or
Patna High Court Cr.Misc. No.51441 of 2016 (3) dt.20-12-2016 successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
