This is the second attempt of the petitioner to seek bail and it has been submitted that altogether six witnesses have been examined and only one witness Urmila Devi is still to be examined and despite letter dated 07.04.2022 being issued to the Superintendent of Police, Saran to produce the said witness, the witness has not turned up. The learned counsel for the petitioner thus submits that on account of delay in examining Urmila Devi, the trial is getting delayed.
The learned A.P.P. opposes the bail application. The Court is not inclined to exercise its jurisdiction to grant bail to the petitioner in the nature of submissions made. Accordingly, the prayer for bail of the petitioner
Patna High Court CR. MISC. No.54441 of 2022(2) dt.12-10-2022 2/2 stands rejected.
However, the learned trial Court is directed to expedite the trial and to conclude the same within two months from the date of receipt/ production of a copy of this order. In the event, if the trial is not concluded within two months, then the petitioner will be at liberty to renew his prayer before the learned trial Court.
