====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-08-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 109, 308(4), 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. According to F.I.R., all the accused persons threatened the informant to hire his men for the post of security guards and when informant refused to do so, the accused persons attacked and fired bulled upon him.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R. and his name transpired during investigation, on the basis of confessional statement of coaccused Jitendra Kumar and Raj Kumar. The only material that has come against petitioner is that as per CDR, this petitioner

Patna High Court CR. MISC. No.53164 of 2025(2) dt.13-08-2025 2/2 had conversation with other accused persons on the day of occurrence, but content of conversation is not known. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Danapur, Patna in connection with Khagaul P. S. Case No. 284 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
