JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-03-2018 In view of the counter affidavit filed on behalf of the Superintendent of Police, Nawada, the petitioner may file an appropriate application in the court below itself seeking release of the seized articles. Earlier the application was rejected by the court below on 11.1.2017 taking a view that the investigation in the matter is still going on. Now this Court had been informed that after investigation, police has found it a case of mistake of fact and in compliance of the direction of the Superintendent of Police, Nawada, a final report no.157 of 2017 dated 19.12.2017 has already been submitted in the concerned court. The court below shall consider the application as and when preferred by the petitioner for such release within a period of two weeks from the date of filing of the application and shall pass an appropriate order

Patna High Court Cr. WJC No.1836 of 2017 (4) dt.28-03-2018 2/2 accordingly.

The application stands disposed of.
