Mr.Anil Kumar Singh No. 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-08-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Ara Town P.S. Case no. 281 of 2019, registered under Sections 307, 341, 323, 379, 504 and 506/34 of the Indian Penal Code.

The accusation is that five persons named in the F.I.R. including the petitioners, surrounded the informant Vikash Kumar Yadav, when informant started fleeing then on the order of Surendra Yadav (Petitioner No.3), Chhotelal Yadav gave iron rod blow at the head of informant, when informant fell down then all caused injury by means of lathi and stick. At that time, they also snatched cash of Rs. 800/- from the pocket

Learned counsel for the petitioners submits that only two injuries were found on the person of informant in which injury no.1 over the mid of the skull, which is grievous in nature, which is attributed against Chhotelal Yadav and second injury is swelling over the wrist, which is simple in nature regarding which the opinion was kept reserved, which is attributed against the five persons named in the F.I.R., including the petitioners. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No. 281 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
