The petitioners apprehend their arrest in Sour Bazar P.S. case No. 150 of 2016 under Section 366A/ 34 of the Indian Penal Code.

Suresh Yadav, the informant, alleged that petitioners along with five others kidnapped his daughter on 22.04.2016. It is submitted that victim made her statement under Section 164 of the Cr. P. C. (Annexure-2). She disclosed that she voluntarily left her house and went along with Manish to Delhi. She was in love with Manish. She disclosed that she does not want to go to her Sasural. Her father married her with Vikash Kumar. The victim did not name the petitioners in her statement under

Patna High Court Cr.Misc. No.39913 of 2016 (2) dt.20-09-2016 2/2 Section 164 of the Cr. P. C.

Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Sour Bazar P.S. Case No. 150 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
