No.930 of 2017 whereby and whereunder the learned Magistrate has taken cognizance of the offence punishable under Section 138 of the Negotiable Instruments Act against the petitioner and summoned him to face trial. After some arguments, Mr. Krishna Prasad Singh, learned Senior Advocate for the petitioner seeks leave to withdraw the instant application in order to raise all the points available to the petitioner at appropriate stage during trial.
