This application for grant of anticipatory bail arises out of Madhubani Town P. S. Case No. 122 of 2016, disclosing offences under Sections 147,148,341,323,324,325,307,379/34 of the Indian Penal Code.
It is evident from the First Information Report that some dispute over title with respect to land between the informant and the accused persons is the reason behind the occurrence and registration of the First Information Report. It is submitted on behalf of the petitioners that injuries
have been found to be simple in nature and no offence under Section 307 of the Indian Penal Code can be said to be made out on the basis of allegations made in the First Information Report. Considering the above, this application is allowed. Let petitioners above named in the event of their arrest/surrender within four weeks from today in the Court below, be released on bal on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in Madhubani Town P. S. Case No. 122 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
