No. 1165 of 2015, which has been dismissed vide order dated 06.02.2017 due to non-prosecution.
It is submitted by the learned counsel for the petitioner that though he had come to the Court on 06.02.2017, at about 11.30 a.m. he received information with regard to illness of his father and out of anxiety he rushed to his house to see his ailing father. Hence, when the case was called out, he could not appear in the case.
Patna High Court MJC No.404 of 2017 (3) dt.18-10-2017 2/2 Learned counsel for the State does not oppose the application for restoration of the writ petition. Considering the submissions made above, the application is allowed. C.W.J.C. No.1165 of 2015 is directed to be restored to its original file.
