In this case, the petitioner is seeking anticipatory bail in connection with Konch P.S. Case No. 186 of 2017, registered for the offence punishable under Section 7 of the Essential Commodities Act, 1955.

While the petitioner was carrying wheat in his tractor, the Block Supply Officer has intercepted him and seized the wheat and said that the said wheat was being carried for black-marketing.

Learned counsel for the petitioner submits that it was not the wheat of the petitioner, but it was the wheat of one Deepak Kumar, who has claimed before the authority for release

Patna High Court Cr.Misc. No.6103 of 2018 (2) dt.02-02-2018 2/2 of the wheat, which has been released by this Court in favour of said Deepak Kumar.

Looking to the aforesaid facts, let the petitioner, namely, Sachidanand Kumar @ Sachchidanand Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-III, Gaya, in connection with Konch P.S. Case No.186 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
