1. Heard learned counsel for the petitioner and the learned APP for the State.

2. The petitioner apprehends his arrest in connection with Baheri P.S. Case No. 34 of 2024 dated 15.02.2024 registered for the offence(s) punishable under Section(s) 406 and 420 of the Indian Penal Code.

3. Mr. Sanjeev Kumar Jha, learned counsel for the petitioner submits that the petitioner has fair and clean antecedent and allegations levelled against him in the FIR are totally false, in fact the petitioner's work was not to disburse the loan to the loanees and admittedly he worked as 'Field Assistant' at the relevant time and his work was only to help and convince the loanees and he has been made victim in furtherance of conspiracy hatched by the informant, however, the petitioner is ready to deposit the alleged misappropriated

4. Mr. Binod Kumar, learned APP appearing for the State has opposed the bail prayer of the petitioner but submitted that in view of the petitioner's undertaking to deposit the alleged amount at the financial institution concerned, a lenient approach may be taken in respect of his bail.

5. Having considered the above submissions and mainly taking into account the petitioner's fair and clean antecedent and his undertaking as to being ready to deposit the alleged amount at the bank concerned, this court is inclined to grant the privilege of anticipatory bail to him. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Baheri P.S. Case No. 34 of 2024 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. with following condition:

The petitioner shall deposit the alleged amount of Rs. 1,10,473/- at the 'Bharat Financial Exclusive Ltd. of Baheri Branch, Darbhanga' before submitting the bail bonds and the
