JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-11-2017 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Counsel for the petitioners submits that petitioner was appointed against physically challenged quota and as such the petitioner deserves treatment as physically challenged and the petitioner is not to be subjected to the recourse applicable to other general candidates.

Mr. Ashutosh Ranjan Pandey, AAG submits that the petitioner was an applicant under general category and as such there is no case of appointment under the physically handicapped quota.

Patna High Court CWJC No.517 of 2017 (2) dt.30-11-2017 2/2 Considering the rival contentions of the parties, it would be appropriate that the petitioner may file representation before the Director, Primary Education alongwith the documents to substantiate that petitioner was appointed under the physically challenged quota.

In case, the petitioner files such representation alongwith the documents to establish that the petitioner was appointed against physically challenged quota, the respondent, Director, Primary Education shall pass appropriate order in accordance with law on the representation filed by the petitioner within a period of 60 days from the date of filing of such representation.

With the aforesaid, the writ application stands disposed of.
