The petitioner apprehending his arrest in connection with Nirmali P.S. Case No. 58 of 2015 registered for the offence punishable under Section 395 and other allied Sections of the Indian Penal Code has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that in the entire case diary no material has been collected against the petitioner and F.I.R. was lodged against unknown. However, on perusal of the record it is evident that in the case robbery was committed at a petrol pump and in C.C.T.V. installed therein the petitioner along with other was captured which was indicted by
Patna High Court Cr.Misc. No.46175 of 2015 (3) dt.27-10-2015 2/2 one of the witnesses during investigation. In such cases there is no question for extending the privilege of anticipatory bail. The petition stands dismissed.
