The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Huge quantity of foreign liquor was recovered from a truck and a pickup van. Allegation is that the same was of the petitioner.

Submission is that neither the truck nor the pickup van was of the petitioner. Only suspicion is there. The statement in para-3 of the bail petition reveals that the petitioner is accused in several cases of identical nature registered under the Bihar Prohibition and Excise Act, 2016.

No.54468 of 2019(2) dt.05-09-2019 2/2 Considering the entire facts, let the petitioner, above named, be released on bail if the trial is not concluded within six months from the date of framing of the charge on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Begusarai Muffasil P.S. Case No.61 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
