JUSTICE SANJAY PRIYA ORAL ORDER 20-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 413, 424 of the Indian Penal Code, Section 4(A) of Bihar Cattle Act and (Cattle Tresspass) H (i) A, B, C. D Act.
It has been submitted on behalf of the petitioner that his name has been disclosed by the driver of the Magic vehicle who was caught on the spot by the police. It has further been submitted that other co-accused with similar allegations have been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 26.10.2016 passed in Cr. Misc. No.43442 of 2016. From the written report itself it appears that the name of the petitioner has been disclosed by the driver of the Magic vehicle.

No.45041 of 2016 (3) dt.20-01-2017 2/2 Considering the facts and circumstances of the case, let the petitioner in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Baniyapur P.S. Case No. 196 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Rakesh Kumar Yadav, Judicial Magistrate, 1st Class, Saran at Chapra, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
