It appears that all the prosecution witnesses in this case have already examined and even their statements under Section 313 Cr.P.C. were also recorded on 10.07.2023 and 11.07.2023 and thereafter this matter is pending before the trial court for examination of the defence witnesses where till now 12 defence witnesses were examined and still it is pending for examination of the defence witnesses.

Patna High Court CR. MISC. No.59569 of 2023(3) dt.06-10-2023 2/2 It appears that delay is out of availing of legal right by petitioners and other co-accused persons.

Considering the same, no merit survive. The prayer of bail is rejected herewith on second consideration also. Both these applications are dismissed.
