In this case, the petitioner is apprehending his arrest in connection with Deepnagar P.S. Case No. 04 of 2018 registered for offences under sections 379 and 188 of the Indian Penal Code and Section 40 of the Bihar Mines and Minerals Regulation Act, 1972 (BMMR) and Section 8 of the Bihar Mining Transportation of Illegal Mining Stage and Prohibition Act, 2003.

As per allegation, the petitioner was bringing stone chips under the valid permit from Birbhum, West Bengal but the Police intercepted, in failure to produce the original record, the truck was seized but, the petitioner was not arrested who was the truck owner.
