2. In this case, the petitioner is seeking regular bail in connection with Nadi P.S. Case No. 322 of 2021, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. The prosecution case in brief is that, on the basis of a secret information, the informant reached near Jeevan Moti Petrol Pump NH-30, where two persons after seeing police got down from a tempo and started running and managed to escape. Thereafter, the police searched the Tempo and 70 litres country made liquor was recovered.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.58694 of 2024(2) dt.22-08-2024 2/2 that the petitioner is innocent and has falsely been implicated. Nothing has been recovered from the conscious possession of the petitioner. His further submission is that the petitioner was not apprehended at the spot. The petitioner is under custody since 05.07.2024.

5. On the other hand, learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner, above-named, is directed to furnish bail bond after two months from today and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna City in connection with Nadi P.S. Case No. 322 of 2021, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
