Petitioners are apprehending their arrest in connection with a case registered for the offences under Section 47(A) of the Excise Act, Sections 2(E), 3(8), 15, 18 of Mahua Phool Act, as it is said that four bags of mahua was found in a hut which is said to be of the petitioner.
It is submitted on behalf of the petitioners that no machine or any other apparatus was found in the hut indicating that mahua kept in the hut was meant for brewing. It is submitted that besides the present case petitioner is not accused in any other case.
Let petitioners, named above, surrender in the
Patna High Court Cr.Misc. No.48146 of 2015 (2) dt.02-11-2015 2/2 court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below and thereafter the court below should verify the antecedent of the petitioners, and if found clean, they be released on bail on furnishing bail bonds of Rs. 5,000/-(Rs. Five Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S. Case No. 48/2015, subject to the conditions laid down under Section 438(2) Cr.P.C.. Until verification no coercive steps be taken against the petitioners. This petition is, accordingly, disposed of.
