JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 498A and 376 of the Indian Penal Code, Section 3/4 of the Dowry Prohibition Act and Sections 4 and 8 of The Prevention of Children from Sexual Offences, Act.
The prosecution case is that Md. Kamran ravished the informant and thereafter married with her but subsequently he refused to take the informant to the matrimonial house. It is alleged against the petitioners who are the brothers of Md. Kamran that initially they obstructed the informant to lodge case and when protest was made then the accused persons assaulted the informant and demanded dowry.
It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.48603 of 2015 (2) dt.13-10-2015 2/2 the thrust of accusation is against Md. Kamran and the petitioners have only been roped in the present case since they happen to be the family members of Md. Kamran. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge-cum-Special Judge, POCSO Act, Bhagalpur in connection with Sultanganj P.S. Case No. 145 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
