The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506, 34 of the

Patna High Court CR. MISC. No.64458 of 2021(3) dt.19-09-2022 2/3 Indian Penal Code.

The informant alleged that all the accused persons surrounded the informant and brutally assaulted him and his brother by means of Tangi and dab. The informant and his brother got serious injuries. The petitioner Gopal Chaudhary assaulted the informant with dab. The informant got cut injury on his hand. When Pappu Kumar Yadav, the brother of the informant came to his rescue, petitioner Madan Chaudhary assaulted with Tangi on his head and Pappu Kumar Yadav got blood oozing injury on his head. The accused persons assaulted all the family members of the informant. It appears that vide order dated 21.06.2021 passed in Cr. Misc. No. 35334 of 2020, the prayer for grant of anticipatory bail of the petitioners has already been rejected by a coordinate Bench of this Court. After some arguments, learned counsel for the petitioners seeks permission to withdraw the petition with a liberty to approach learned Court below for grant

Patna High Court CR. MISC. No.64458 of 2021(3) dt.19-09-2022 3/3 of regular bail.

Permission is accorded.

Accordingly, the petition is dismissed as withdrawn with a liberty to the petitioners to surrender before learned Court below and pray for regular bail. The learned Court below may consider the regular bail of the petitioners, keeping in view the facts that both sides have compromised the case and appropriate petition has already been filed before appropriate forum for compromise the matter.
