The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 323, 406, 498A of the Indian Penal Code and Section 3/4 of the D. P. Act.
The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that her marriage was solemnized with Balmiki Kumar @ Balmiki Das on 15.06.2019 and after
Patna High Court CR. MISC. No.64962 of 2021(2) dt.27-07-2022 2/3 marriage, the accused persons including the petitioner started demanding dowry and non-fulfilment of the dowry, led to torture and cruelty. It is next alleged that on 20.08.2019, the informant was ousted from her matrimonial home. The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case. It is next submitted that after marriage, the husband of the informant realized that the informant has some white spots on the body as a result of which, there was a dispute. It is next submitted that the husband of the informant presumed that she was suffering from leprosy and concealing the said fact, the marriage was performed.
It is further submitted that on account of the said dispute between the husband and the wife, the present case came to be instituted implicating the entire family members of the husband of the informant. The learned counsel further submits that the husband has also filed anticipatory bail application being Cr. Misc. No.69933 of 2021 in which notices have been issued on the opposite party no.2 herein. Learned A.P.P. opposes the bail application.
Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below
Patna High Court CR. MISC. No.64962 of 2021(2) dt.27-07-2022 3/3 within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Sidhawaliya P. S. Case No.145 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
