JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kajra P. S. Case No. 61 of 2018, registered for the offence punishable under Sections 147, 148, 149, 353, 307 of the Indian Penal Code and Section 27 of the Arms Act as well as Sections 16, 17, 18, 20, 23 of the U. A. P. Act.
Altogether 60 persons including petitioner were shown as Naxalite in the FIR and it is said that the petitioner and other FIR named accused persons assembled with an object to commit crime. However, it is also said that when police party raided, the petitioner and others made indiscriminate firing. It is obvious from perusal of the FIR that not a single police official
Patna High Court CR. MISC. No.53001 of 2019(3) dt.16-11-2019 2/2 sustained any injury though, allegedly, in the huge quantity, weapons and other materials were recovered from the place of occurrence. Petitioner does have criminal antecedent of only one case that too, registered only for minor offences of IPC. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner, above named, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Kajra P. S. Case No. 61 of 2018, subject to conditions as laid down under Section 438(2) of the CrPC.
