2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 25(1-b)a, 26, 35 of Arms Act
3. As per prosecution case, this petitioner along with one other F.I.R. named accused persons was waiving country made pistol and scaring people on the occasion of immersing idol at Jhakhra Balua.
4. Learned counsel for the petitioner submits that petitioner no arms and ammunition has been recovered from possession of petitioner and he has been made accused on the basis of confessional statement of co-accused. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed
Patna High Court CR. MISC. No.58103 of 2024(2) dt.18-09-2024 2/2 the bail application.

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, East Champaran, Motihari in connection with Piprakothi P. S. Case No. 32 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
