The Petitioner apprehends his arrest in Mufassil (Lakha) P.S. Case No.482 of 2015 instituted for the offence under Section(s) 364/34, 302 Indian Penal Code. It has been submitted that the name of this petitioner has come merely on suspicion.
From the written report itself, it appears that the informant has alleged that this petitioner is brother of father of the informant. The informant has alleged that his father in collusion with her first wife and the children of first wife has killed the mother of the informant, who was his second wife. In
Patna High Court Cr.Misc. No.51246 of 2016 (3) dt.13-02-2017 2/2 such manner there is mere suspicion raised against the petitioner. Counsel for the Opposite Party No.2 has appeared and submits that there is involvement of this petitioner, which will be clear from the case diary.
Learned APP has submitted that in the case diary mere suspicion has been raised against this petitioner. In the facts and circumstances of the case, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Muffasil P.S. Case No.482 of 2015, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, subject to the conditions as laid down under Section 438(2) Cr. P. C.
