The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 324, 379 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and they have been implicated in the case as they are related to Navin Singh and the informant alleges that on 02.07.2020 at about 9:00 AM, her son Pankaj was working at his door when in the meantime, the named accused persons, including the petitioners, came and it is

No.63812 of 2021(2) dt.18-07-2022 2/3 alleged that the accused persons assaulted her son with bhala, khanti, lathi-danda causing injury on his head and shoulder and when the informant came to rescue him, she was also assaulted by bhala on her head on account of which she sustained injury and the accused persons left the place of occurrence thinking that the informant has died and even snatched her golden chain. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the present case with general and omnibus allegation of assault. It is further submitted that from perusal of the allegation as alleged in the F.I.R.

it would manifest that no reason or motive has been assigned for the occurrence, it is submitted that on account of land dispute, the present occurrence took place but since the petitioners are related to Navin Singh, one of the accused of the case, as such they also came to be implicated in the present case. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners and the fact that the petitioners are women and petitioner nos.2 and 3 are aged about 18 and 21 years respectively, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a

Case No. 375 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
