Learned counsel appearing on behalf of the petitioner submits that the petitioner has been granted provisional bail vide order dated 18.09.2017 passed in Criminal Miscellaneous No. 15423 of 2017 with a direction to surrender before the court below within a period of four weeks in connection with Goh P.S. Case No. 70 of 2016, pending in the Court of Chief Judicial Magistrate, Aurangabad and provisional bail of the petitioner will be confirmed by the court below on submission of receipt of Rs. 6,44,695/- but due to some unavoidable circumstances, petitioner could not surrender before the court below within the stipulated time.

No.3336 of 2018 (2) dt.17-01-2018 2/2 In such view of the matter, let the time to surrender of the petitioner as order passed in Criminal Miscellaneous No. 15423 of 2017 on 18.09.2017 be further extended by four weeks from today in connection with Goh P.S. Case No.70 of 2016 pending in the court of Chief Judicial Magistrate, Aurangabad. Accordingly, the modification application is allowed and the order dated 18.09.2017 passed in Criminal Miscellaneous No. 15423 of 2017 is modified to the above extent.
