This application, for grant of anticipatory bail, arises out of Amdabad P.S. Case No. 75 of 2016, disclosing offences under Sections 341, 323, 504, 325, 307/34 and 379 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that allegation against the petitioner is of assaulting on head by sword, but the injuries caused is simple in nature.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that the assault is on the head and that too by the sword, I am not inclined to grant the petitioner the privilege of anticipatory bail, it is accordingly rejected.

However, if the petitioner surrenders before the Court

Patna High Court Cr.Misc. No.49580 of 2016 (2) dt.14-12-2016 2/2 below, his prayer for regular bail shall be considered by learned Court below on its own merit without being prejudiced by the order of this Court.
