====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner, State and the informant.
Petitioner is apprehending his arrest in connection with a case registered for the offences under Sections 307, 354A and other allied Sections of the Penal Code. He is named in the First Information Report along with four others. It is said that he is 78 years old and the allegations levelled against him does not appear to be true. Counsel for the informant opposed the submission and submitted that in order to oust the informant from her dwelling house, she is being assaulted by the petitioner and his
Patna High Court Cr.Misc. No.48202 of 2015 (2) dt.03-11-2015 accomplice.
In view of the submission of the learned counsel for the informant counsel for the petitioner has agreed not to disturb the informant from her possession of the dwelling house and the lands attached thereto, except by the process of the Court.
In view of the submissions made, counsel for the informant has also agreed that informant will also not disturb the petitioner from his possession over other portion of the house and the lands attached thereto, except by the process of the Court.
In the light of the undertaking given by counsel for both the parties, let petitioner, named above, surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below and file such undertaking on affidavit and in the light of the undertaking be admitted to the privilege of bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial
