JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 21-04-2016 The petitioner seeks quashing of the order dated 6.5.2015 by which he has been suspended with immediate effect by the Director, Agriculture, Bihar, Patna in view of report of his unauthorized absence from the block headquarters and lack of interest in departmental work.

The petitioner assails the suspension order stating that no charge has been framed against him till date. Counsel for the State referring to the counter affidavit submits that the charge memo has already been prepared and altogether five charges have been framed against the petitioner. A copy of the charge memo dated 6.5.2015 is contained in Annexure B to the counter affidavit.

Patna High Court CWJC No.16247 of 2015 (2) dt.21-04-2016 2/2 Having regard to the facts and circumstances of the case, the writ petition is disposed of with direction to the respondents to conclude the departmental proceeding within a period of eight months from the date of receipt/production of a copy of this order, failing which the suspension order would stand vacated.
