The petitioner apprehends his arrest in Tikapatti P.S. case No. 133 of 2015 under Section 304B, 201/34 of the Indian Penal Code.

The informant alleged that he married his sister, Sanjida Khatoon, with Azim Mansoori about 7-8 years ago but her husband and other family members were always subjecting her to physical and mental torture due to non fulfillment of demand of dowry. His sister informed on telephone that her husband and his family members brutally assaulted her. The informant named the petitioner also.

It is submitted that petitioner is next door neighbour of the husband of deceased and he has no manner of concern with

Patna High Court Cr.Misc. No.26943 of 2016 (3) dt.01-09-2016 2/2 the family affairs of deceased or her husband. The learned Additional Public Prosecutor did not dispute this fact.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Purnea in Tikapatti P.S. Case No. 133 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
