The petitioner seeks bail in connection with Town P.S. Case No. 713 of 2021 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 18.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 20 litres of country-made liquor and 10.140 Indian made foreign liquor from a plastic gallon and

Learned counsel for the petitioner submits that the pillion rider had kept the aforesaid plastic gallon and the sack and as such the petitioner was not knowing what was kept in them.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 18.09.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Town P.S. Case No. 713 of 2021.
