The petitioner who is in custody since 24.03.2019 has filed the instant application for grant of bail in connection with Madhuban P.S. Case No.55/2019 registered for the offence punishable under section 304 of the Indian Penal Code. As per the allegation in the FIR, out of misunderstanding the petitioner is said to have assaulted the father-in-law of the informant with a bamboo (Fhattha). It is further stated in the FIR by the informant that the petitioner had no intention to kill her father-in-law.

It is submitted by learned counsel for the petitioner that there is delay of two days in lodging of the FIR, the petitioner has got no criminal antecedent and he is custody since 24.03.2019.

Having heard learned counsel for the parties and taking into consideration the above facts including the petitioner having no criminal antecedent, being in custody since 24.03.2019 and the delay in lodging of FIR the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran, Motihari in connection with Madhuban P.S. Case No.55/2019.
