====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 23-08-2023 Heard learned Counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner is apprehending his arrest in connection with Excise P.S. Case No.216 of 2022 dated 25.07.2022, lodged under Sections 30(a), 56 (2) (ii) of the Bihar Prohibition and Excise Act, 2016.

3. As per prosecution case, the petitioner is not named in the F.I.R., rather his name has figured being the owner of the vehicle which was alleged to be used in commission of the crime.

4. Learned counsel for the petitioner submits that petitioner is old aged person of about 68 years. He further submits that petitioner is not involved in such type of activities

No.54628 of 2023(2) dt.23-08-2023 2/2 and his antecedent is clean but the said motorcycle which was registered in his name used to be use by his son and his son's friend and it is not due to petitioner rather it is due to involvement of his son and his son's friend his name has come in this case.

5. Learned A.P.P. for the State opposes the prayer for bail.

6. In the present facts and circumstances, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court - 2, Nawadahin, in connection with Excise P. S. Case No.216 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
