JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Khagaria (Gangaur) P.S. Case No. 785 of 2017 registered for the offences punishable under Sections 147, 148, 307, 324, 379, 448, 504 and 506/34 of the Indian Penal Code. Allegation against the petitioner No.1 is that he assaulted by means of Hansuli, causing injury on the head of the informant and there is allegation of snatching of chain against petitioner No.2 Submission of learned counsel for the petitioners is that there is case and counter case between the parties and injuries on the person of informant are found to be simple in nature, which will appear from Annexure-2.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangaur) P.S. Case No. 785 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
