This Court on perusal of the records would find that the order of dismissal of the petitioner has been passed after holding departmental enquiry. The charges against the petitioner were quite serious, inasmuch as it was said that she had been caught red-handed while accepting bribe. In the departmental proceeding that was held this Court does not find any procedural infirmity. In that view of the matter, this writ application must fail but then it is made clear that as the petitioner still is facing the trial in the criminal case being Vigilance P.S.Case No. 032/2014 dated 25.4.2014 for offence under section 7/13(2) read with section 13(1)(d) of the Prevention of Corruption Act, 1988 in which sanction of prosecution has also been given by the State
Patna High Court CWJC No.15544 of 2015 (2) dt.01-10-2015 Government on 30.5.2014, the trial court should ensure that the trial of the petitioner is expedited and also brought to an end preferably within a period of one year from the date of receipt of this order.
Subject to the aforementioned observations and directions, this application is dismissed.
Let a copy of this order be sent to the concerned Special Judge, Vigilance, Patna dealing with the trap cases. (Mihir Kumar Jha, J) surendra/- U
