The sole petitioner, apprehending his arrest in Kursakanta ( Kuwari O.P.) P.S. Case no.24 of 2016 registered for the offence under Sections 18 and 19 of the N.D.P.S. Act, has prayed for grant of bail, in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that on a land about 400 plants of Opium was noticed. It was also noticed that it was land of the petitioner and he was indulged in cultivating Opium. He submits that the description of the land has not been mentioned in the F.I.R. Sri R.B.Roy Raman, learned Addl.

Patna High Court Cr.Misc. No.55016 of 2016 (2) dt.22-12-2016 2/2 Prosecutor has opposed the prayer for grant of bail of the petitioner. He submits that the petitioner is named accused in the F.I.R. with specific accusation that the petitioner is indulged in cultivating Opium.

Keeping in view the nature of accusation, as well as considering the fact that the petitioner has been arrayed as accused in the F.I.R. and is indulged in cultivating opium, there is no reason to extend the privilege of anticipatory bail. The petition stands dismissed.
