JUSTICE RAMESH KUMAR DATTA ORAL ORDER 06-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner prays for anticipatory bail in a case under Sections 294(A), 420, 467 of the Indian Penal Code and Section 7(3) of the Lottery Regulation Act, 1998. It is submitted by learned counsel for the petitioner that the petitioner was not caught on the spot by the police when they conducted the raid rather at the instance of two of the co-accused persons he was named as their associate who had managed to flee away from the place of occurrence. It is further submitted that the petitioner does not have any criminal antecedent and he has been falsely implicated in this case merely because he is a resident of the same locality as those co-accused

On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Raju Khan, in the event of his arrest/surrender in the court below within a period of four weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sadar (Purnea) P.S. Case No. 269/2015 to the satisfaction of the Chief Judicial Magistrate, Purnea, subject to the other conditions laid down under Section 438(2) Cr.P.C.
