The petitioner seeks regular bail in connection with Maner Rail PS case no. 620 of 2018 instituted for the offences punishable under Sections 302/34 of Indian Penal Code and 27 of Arms Act.

The allegation is regarding 11 accused persons including the petitioner having shot dead the deceased, who is the brother of the informant.

The learned counsel for the petitioner submits that there is no specific allegation of any overt act as against the petitioner herein of having shot dead the deceased and the petitioner has been falsely implicated in the present case. It is further submitted that almost all the other co-accused persons

Patna High Court CR. MISC. No.50224 of 2019(4) dt.30-09-2019 2/2 have been granted bail vide order dated 01.05.2019 passed in Cr. Misc. no. 28664 of 2019, order dated 17.06.2019 passed in Cr. Misc. no. 21518 of 2019, order dated 01.04.2019 passed in Cr. Misc. no. 19513 of 2019 and order dated 05.07.2019 passed in Cr. Misc. no. 41570 of 2019. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 19.06.2019.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Danapur, Patna in connection with Maner PS case no. 620 of 2018.
