====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-08-2019 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 8/20(b)(ii)(c), 25, 29 and 30 of the Narcotic Drugs and Psychotropic Substances Act, 1985. From the house of this petitioner, 430 Kg. of Doda powder and scrapes were recovered. Co-accused Birendra Prasad, who is full-brother of the petitioner, is also an accused in this case.
Submission is that petitioner had no knowledge about the recovered narcotics. Petitioner is in custody since 27.11.2017.
Earlier prayer for bail of the petitioner was refused on 13.02.2018 passed in Cr. Misc. No. 8629 of 2018 vide Annexure-1.
Patna High Court CR. MISC. No.53231 of 2019(2) dt.29-08-2019 2/2 Trial has not concluded as yet. Petitioner is ready to cooperate with the trial.
Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Imamganj Police Station Case No. 203 of 2017, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
