The petitioners apprehend their arrest in Runnisaidpur P.S. case No. 289 of 2016 under Section 308 and other Sections of the Indian Penal Code.

The informant alleged that the accused persons cut earth from the road and when the informant objected Jugeshwar Sah, petitioner No.1, assaulted Gita Sinha, wife of the informant, with Lathi on her head. Petitioner No.2 assaulted son of the informant, Dilip, with Farsa on his head.

The learned counsel for the petitioners submits that informant, Madan Kumar, is own brother of petitioner No.1, Jugeshwar Sah. There is land dispute between the parties. Some

Patna High Court Cr.Misc. No.39667 of 2016 (2) dt.17-09-2016 2/2 altercation took place. Wife and son of the informant got simple injuries. The case has been compromised.

Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Runnisaidpur P.S. Case No. 289 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
