JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 18-02-2016 The petitioner seeks anticipatory bail in a criminal prosecution registered under Sections 307/34 and some other allied offences under the Indian Penal Code.
The learned counsel appearing on behalf of the petitioner has fairly submitted that, during the course of investigation, accusation against the petitioner was not supported by the independent witnesses and, therefore, in all probabilities, the police is likely to submit final report and the petitioner may not be sent up for trial. Hence, it is contended that he may be permitted to withdraw the present application since, at the moment, the petitioner has no apprehension of arrest but, with a liberty to file a fresh application, if the cause of action so arises. Permission is accorded.
The present application for grant of anticipatory bail stands disposed of as withdrawn with the liberty aforesaid. (Birendra Prasad Verma, J) Tahir/- U T
