Petitioners in these two petitions are the father-inlaw, mother-in-law and the husband of the deceased. They are apprehending their arrest in connection with a case registered for
Patna High Court Cr.Misc. No.48188 of 2015 (3) dt.03-11-2015 2/3 the offence under Section 306/34 of the Penal Code and are named in the First Information Report. It is, however, submitted on their behalf that after filing of the case informant realised that his daughter died because of accidental burn injuries and not burnt to death. Having realised such fact he filed compromise petition dated 19.08.2015, Annexure-2 supported by an affidavit. Let petitioners in both the petitions along with the informant appear before the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below excluding the Holidays and if the informant admits that under some misconception he filed the present case and thereafter having realised the position has filed compromise petition dated 19.08.
2015, Annexure-3 the petitioners, named above, be admitted to the privilege of bail on furnishing bail bonds of Rs. 5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in Ramgarh P.S. Case No. 212 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C..
