The petitioners, seven in number, apprehend their arrest in a case under Sections 147, 148, 149, 341, 323, 307, 448, 504, 379, 436, 427 of the Indian Penal Code and Section 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.
The informant made specific allegation against Arun Thakur that he assaulted Prabhu Kumar Sharma with Gadansa causing cut injury on his head. The other accused persons assaulted Pankaj Kumar Ramnagina Sharma. Arun Thakur and Pankaj Thakur are alleged to have set ablaze the hut of Pramila Devi. No specific allegation is made against the petitioners. The
Patna High Court Cr.Misc. No.48218 of 2015 (2) dt.17-12-2015 2/2 informant, Prabhu Kumar Sharma and Ramnagina Sharma got lacerated wounds caused by hard and blunt substance and simple injuries. No offence under Section 3(1)(x) of SC/ST Act is made out.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Sakra P.S.
