Learned counsel for the petitioners seeks permission to withdraw this application of the petitioner no.1 and the same is dismissed as withdrawn.

The petitioners seek bail in connection with Turkaulia P.S. Case No. 664 of 2021 registered for the offence under Sections 302, 120B, 34 of the Indian Penal Code, 1860. As per the prosecution case, the petitioner no. 2 Upendra Ram is named in the F.I.R. but there is no allegation against him.

Learned counsel for the petitioners submits that the petitioners are in custody since 07.06.2023.

Patna High Court CR. MISC. No.56308 of 2023(2) dt.30-08-2023 2/2 Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia P.S. Case No. 664 of 2021.
